For more information: http://www.resisters.ca/ *** DECLARATION During the period of 1965-1973, more than 50,000 Americans made their way to Canada, refusing to participate in an immoral war. At the time, Prime Minister Pierre Trudeau said: "Those who make a conscientious judgment that they must not participate in this war... have my complete sympathy, and indeed our political approach has been to give them access to Canada. Canada should be a refuge from militarism." Thirty years later, Canada is faced with the same moral choice -- to give refuge to those who refuse to be complicit in the US-led war on Iraq, which many legal opinions have deemed illegal under international law. In January of 2004, Jeremy Hinzman, a soldier in 82nd Airborne Division, made his way to Canada seeking refugee status with his wife, Nga, and son, Liam. Brandon Hughey arrived in March 2004, and David Sanders surfaced in Toronto in May 2004. Since then, a growing number of American soldiers and their families have made the decision to seek sanctuary in Canada. In December 2004, the Canadian government intervened in Jeremy Hinzman's hearing before Canada's Immigration and Refugee Board, asserting that the legality of the war had no relevance to his claim. The refugee hearing officer accepted the government's argument. This decision fails to acknowledge a critical moment in 20th Century world history. Following the Second World War, the Nuremberg Tribunal set out important principles of international law. Those principles established that soldiers have a moral duty, not a choice, to refuse to carry out illegal orders. Jeremy Hinzman is appealing the Refugee Board decision to a Federal Court, where he is hopeful that international law will be given a proper hearing. But regardless of the decision of the refugee board or the courts, Canada should not punish US war objectors for exercising their conscience and refusing to fight. If they are returned to the United States, they face court martial before a military tribunal and years in prison. Even the death penalty remains on the books in the U.S. as a possible punishment for desertion during wartime. Canada must not facilitate the persecution of American war objectors by returning them to the United States. The majority of Canadians did not support this war. The Canadian government did not support this war. We, the undersigned, call on the Canadian government to demonstrate its commitment to international law and the treaties to which it is a signatory, by making provision for US war objectors to have sanctuary in this country. Video made by: The Evil Persian =========================== Background history: The Iraqi Imposed war began when Iraq invaded Iran on 22 September 1980. Although the Iraqis attacked without formal warning, they failed to make progress and were soon repelled by the Iranians. Despite several calls for a ceasefire by the United Nations Security Council, hostilities continued until 20 August 1988; the last prisoners of war were exchanged in 2003. Iraq's army was primarily equipped with weaponry it had purchased from the Soviet Union and its satellites in the preceding decade. During the war, it purchased billions of dollars worth of advanced equipment from the Soviet Union, France,[31] as well as from the People's Republic of China, Brazil, Egypt, Germany, and other sources (including Europe and facilities for making and/or enhancing chemical weapons). Germany[32] along with other Western countries (among them United Kingdom, France, Spain (Explosivos Alaveses), Canada, Italy and the United States) provided Iraq with biological and chemical weapons technology and the precursors to nuclear capabilities The U.S. sold Iraq $200 million in helicopters, which were used by the Iraqi military in the war. These were the only direct U.S.-Iraqi military sales and were valued to be about 0.6% of Iraq's conventional weapons imports during the war. With more than 100,000 Iranian victims[56] of Iraq's chemical weapons during the eight-year war, Iran is one the countries most severely afflicted by weapons of mass destruction. The Simon Wiesenthal Center, a Jewish organization dedicated to preserving the memory of the Holocaust, released a list of U.S. companies and their exports to Iraq. The official estimate does not include the civilian population contaminated in bordering towns or the children and relatives of veterans, many of whom have developed blood, lung and skin complications, according to the Organization for Veterans of Iran. According to a 2002 article in the Star-Ledger: "Nerve gas agents killed about 20,000 Iranian soldiers immediately, according to official reports. Of the 90,000 survivors, some 5,000 seek medical treatment regularly and about 1,000 are still hospitalized with severe, chronic conditions. Many others were hit by mustard gas..."[57] Iraq also used chemical weapons on Iranian civilians, killing many in villages and hospitals. Many civilians suffered severe burns and health problems, and still suffer from them. Furthermore, 308 Iraqi missiles were launched at population centers inside Iranian cities between 1980 and 1988 resulting in 12,931 casualties.[56]

No more clemency appeals for Canadians on death row in U.S.:

Public Safety Minister Stockwell Day said he won't ask American authorities to hand over Ronald Allen Smith, an Alberta man who has been on death row in Montana for more than 20 years. "We will not actively pursue bringing back to Canada murderers who have been tried in a democratic country that supports the rule of law," Day told the House of Commons on Thursday. "It would send a wrong message. We want to preserve public safety here in Canada." Smith faces death by lethal injection for murdering two men in 1982 during a road trip south of the border in 1982. He is the only Canadian currently on death row in the U.S. For years, it's been standard practice for Canada to lobby foreign governments to show mercy to its citizens when they face the death penalty. Ottawa would ask that their sentence be reduced to life in prison or request that the prisoner serve their term in a Canadian penitentiary. But that policy has now officially changed. Liberal Leader Stéphane Dion said Canadians should take this as a warning that if the Conservatives get a majority, the debate over capital punishment could be reopened. "The fact that this government doesn't even want to try [asking for clemency] shows me what this government would try doing to Canada if they had a majority," Dion said. NDP Leader Jack Layton said if the government won't even try to stop the execution of a Canadian citizen, it's in effect condoning capital punishment. "You know, Canada is a country that doesn't accept the death penalty. And we've had a long tradition of defending that position." Liberal MP Irwin Cotler — a former justice minister and human-rights lawyer — says he was shocked by the Conservative announcement. "We're not asking that [Smith] be returned to Canada," Cotler said. "We're not saying he didn't get a fair trial. We are saying that on the issue of capital punishment, this country has a law, this country has a policy, this country has a principle domestically and internationally. We will not support capital punishment. Fini. "What I heard from the Conservative benches was: 'You support murderers.' Frankly, that is scandalous and shocking." Liberals also noted that Canadian law prevents the extradition of an American to a state that uses capital punishment. "Are we going to in fact change our extradition law as well as changing our policy on capital punishment?" Cotler asked. In Canada, a 1967 bill placed a moratorium on the death penalty, except in cases involving the murder of a law-enforcement officer. A bill to officially ban the death penalty passed in a free vote in 1976. Smith, who is from Red Deer, Alta., was sentenced to death in March 1983. Seven months earlier, he killed two aboriginal men who offered him a ride while hitchhiking. He marched cousins Harvey Mad Man, 23, and Thomas Running Rabbit, 20, into the woods by the highway and shot them both in the head with a sawed-off .22-calibre rifle. Montana Gov. Brian Schweitzer has said he is undecided about whether to commute Smith's sentence.
