Act of the Scottish Parliament, Usually written in the lower case as 'asp'. Whilst UK Acts (statutes) are considered to be Primary Legislation, Acts of the Scottish Parliament (asps) are considered to be subordinate legislation (like statutory instruments etc.) since the Scottish Parliament has had its powers conferred on it by the Scotland Act 1998 which is an Act of the UK Parliament. Much like a Secretary of State receives their power to make Statutory Instruments by an Act of Parliament, so the devolved Parliament of Scotland receives it's powers from a Westminster statute also.
The Scotland Act 1998 provides a reserved model of devolution whereby the right to legislate on certain areas of public policy are reserved to Westminster (e.g. defence). The Sovereignty of the UK Parliament means that any Scottish Act which seeks to legislate on a reserved matter or override provisions made by a UK Act will be deemed invalid and ultra vires (outwith the powers).
